Terms of Service
These Terms and Conditions govern the relationship between the Seller and the CUSTOMERS who use the online store www.pironetic.com to purchase goods. Any use of the Website, including clicking on an object, image, link (other than the General Terms) or a button located on the website www.pironetic.com, is deemed by the CUSTOMER to be aware of, accept and agree to the following Terms and Conditions and expressly agrees to conclude distance contracts for the purchase of goods. These General Terms and Conditions comply with the requirements of the Consumer Protection Act (CPA), as well as with other normative acts in force in the Republic of Bulgaria.
The General Terms and Conditions may be unilaterally changed by the seller GOTAWEAR EOOD at www.pironetic.com at any time by updating them. These changes take effect immediately and are binding on each CUSTOMER and in each case of change of the General Terms, GOTAWEAR EOOD will inform the CUSTOMERS on www.pironetic.com by posting the changes on the site www.pironetic.com.
"SELLER" is the company GOTAWEAR EOOD, registered with UIC 204065241 in the Commercial Register at the Registry Agency, which operates the website www.pironetic.com, which is a virtual platform for the sale of goods. The seller is the person with whom the CUSTOMER enters into a distance sale contract for a specific good (item) in the online store.
"CUSTOMER" is a capable person who has agreed to these General Terms and Conditions in connection with the ordering and purchase of the goods offered in the online store.
"ELECTRONIC SHOP" is the website www.pironetic.com, which serves as a virtual platform for offering goods for sale and reaching an agreement between the SELLER and the CUSTOMER to order and buy and sell a specific product (item).
"GOODS / PRODUCTS" means any item available on the website www.pironetic.com subject to the distance purchase contract.
"ORDER" is a request made by a CUSTOMER to an online store to buy one or more specific goods (articles). The order is packaged and sent by courier to a previously specified address by the CUSTOMER.
The "SALES AGREEMENT" (hereinafter referred to as the Contract) is the contract for the sale and sale of goods between Seller and CUSTOMER from a distance through this e-shop.
1. CONDITIONS FOR PURCHASING GOODS THROUGH THE ONLINE SHOP
1.1. The following persons may be CUSTOMERS: capable natural persons of at least 18 years of age, or legal entities duly registered and existing, in accordance with applicable law.
1.3. As soon as the completion of the order form is completed, the person wishing to place an Order, in his capacity as a CUSTOMER, and the Seller conclude a contract, the object of which is the provision of goods from the online shop, by the Seller of the CUSTOMER, under the conditions set out in these Terms and Conditions. Any subsequent purchase by the CUSTOMER, requested by filling in the order form, shall be subject to these General Terms and Conditions.
1.4. The Seller allows the use of the e-shop by the CUSTOMER provided that the data specified in point 1.2. are valid and valid.
1.5. As a result of an order made by the CUSTOMER by completing the order form, the Seller creates a CUSTOMER profile with a username corresponding to the email completed in the order form.
1.6. The CUSTOMER account contains the information specified in the order form. In the event that part of the data changes in the future, the CUSTOMER should immediately update them when filling in the order form available on the website www.pironetic.com. The CUSTOMER has no right to delete the data specified in item 1.2. and provide incorrect or incomplete information while using Seller's services through the online store. An email must be specified for each account.
1.7. The CUSTOMER may have more than one account, but they cannot be used to perform activities that violate these Terms of Service.
2. CONDITIONS FOR USING THE ONLINE SHOP
2.1. Browse the online store www.pironetic.com is completely free and accessible from anywhere in the world.
2.2. In order to shop online at www.pironetic.com, an order is required (registration is optional), which is completely free. After a successful order, through the newly created account, the registered CUSTOMER gets the opportunity to use all the services of the store.
2.3. The e-shop www.pironetic.com lists each product with the price, the main characteristics of the product and additional information aimed at helping to make an informed choice when buying the product.
2.4. All prices quoted on the site are in EUR (EUR) including VAT and all other legally required taxes when the purchased goods will be delivered to the territory of the Republic of Bulgaria. The prices of the goods do not include the fees under item 6.5 below, as well as the delivery costs according to item 4.3 of these General Terms, which are at the expense of the CUSTOMER.
3.1. In order to place an order to the online store, the CUSTOMER must fill in the necessary order data on the Seller's website.
3.2. For the delivery date of the goods, the data provided by the CUSTOMER at the order made by him shall be used. By submitting the order, the CUSTOMER allows the Seller to contact him in any possible way when necessary in connection with the placed order.
3.3. Upon successful completion of the order, the CUSTOMER receives a confirmation of the order by email at the email address specified by him. The email confirmation indicates the order number, the date the order was placed, the product ordered, and its price.
3.4. In case the goods ordered (specific model) are not available, the Seller shall notify the CUSTOMER by email at the email address specified by him. If the CUSTOMER does not agree to order the other product (similar model), the order may be canceled.
3.5. Orders in the online store www.pironetic.com are accepted 24 hours a day, 7 days a week, but processed within 48 hours after receipt, only on official business days in the Republic of Bulgaria.
3.6. Orders made through a CUSTOMER profile that contains inaccurate or incomplete user data under these General Terms and Conditions are canceled. Whenever possible, the Seller will send an email to the CUSTOMER notifying the incorrect/incomplete information.
3.7. Before the goods are delivered to the Courier, the customer may refuse any order, without having to state the reasons for the refusal, within 14 days from the completion of the order. If the goods have already been delivered to the courier then the rules in section 7 of these General Terms and Conditions apply.
3.8. Cancellation of an order may be made electronically by email to the email address listed on the site - email@example.com or by other unambiguous application, provided that the goods ordered have not been delivered to the courier for dispatch to the CUSTOMER at the time of failure. In order for the cancellation to be valid, the CUSTOMER must provide the order number, his two names and the email address (email) he has provided during the execution of the order, as well as the price of the order.
4.1. Delivery is only made on successfully received orders.
4.2. The Seller has the right to refuse to fulfill the order made by the CUSTOMER, which should be notified to the CUSTOMER. The cancellation of the order does not entail any liability or subsequent obligation of either party to the other, except for the obligations under item 7.3 below in case the product has already been paid by the CUSTOMER.
4.3. The terms, price, and terms of delivery of the goods are determined by the Courier according to the terms and tariffs of the Courier. The terms and the price of the delivery of the Products are visible to the CUSTOMER in the respective Courier page, which is accessible through his active name in the text under each Product.
Courier is a merchant (supplier) who physically delivers the purchased goods to the address specified by the CUSTOMER and works under the requirements of the Postal Services Act.
"BROCHURE / NOTICE" are electronic information messages relating to goods sold in the online store over a period of time, which may be posted on the Website.
4.4. The cost of delivery of the ordered goods is not included in the price indicated in the online shop. The delivery price is determined according to the type of goods and the place of their delivery according to the tariffs of the courier company used by the Seller.
4.5. With the order, the CUSTOMER is deemed to have given his explicit consent to pay the total value of the order, including the delivery costs according to the terms and tariffs of the Courier.
4.6. The delivery of the ordered goods is carried out from Monday to Friday without the days of official and national holidays celebrated in the Republic of Bulgaria.
4.7. When sending the goods ordered, the CUSTOMER receives a confirmation of successful sending by email to the email address he/she has specified. The confirmation email contains a link (link) to the Courier system and the consignment note number for sending the ordered goods, through which, through the use of the site and the Courier system, the CUSTOMER can track the movement of the ordered goods until their arrival as well as the price of delivery of goods.
4.8. Delivery is made to the address specified by the CUSTOMER in the order form.
4.9. Each shipment is insured, the insurance is at the expense of the Buyer and is included in the delivery price.
4.10. If the CUSTOMER does not provide access and conditions for delivery of the goods to the specified address within the specified time, the Seller shall be released from the obligation to fulfill the ordered delivery. In this case, the cost of delivering the goods and returning them by courier is at the expense of the CUSTOMER.
5. TRANSFER OF OWNERSHIP
The ownership of the Products will be transferred to the CUSTOMER after the payment has been made by the CUSTOMER. The delivery of the goods will be certified by the signature of the CUSTOMER of the transport document provided by the Courier.
6.1. Payment for the goods ordered can be made according to the methods described in item 6.1.1 and item 6.1.2 below.
The possible ways to pay for the order are as follows:
6.1.1. With cash on delivery - cash payment to the courier upon delivery to the territory of the Republic of Bulgaria, Romania, and Greece;
6.1.2. via BrainTree - when delivered abroad.
6.2. The price of each product can change dynamically. For each product ordered, the CUSTOMER must pay the price stated in the online store at the time of ordering.
6.3. The cost of delivery of the ordered goods is not included in the price indicated in the online shop and is paid separately in the amount determined by the Courier according to its terms and tariffs, according to the weight of the ordered goods.
6.4. The expenses related to the duties, taxes and other fees in connection with the ordered goods, which will be delivered outside the territory of the Republic of Bulgaria, shall be paid by the CUSTOMER in accordance with the applicable legislation of the country in which the goods are delivered. They are by no means owned by the Seller.
6.5. When making payments through PayPal, the Seller is not responsible for any costs related to fees, commissions or other additional payments made by the CUSTOMER or his bank in connection with the transaction itself, as well as in cases of currency exchange, applied by the bank in cases where the currency is different than BGN. The costs associated with such payments are only at the expense of the CUSTOMER.
6.6. Invoices are issued only in the name of the CUSTOMER who placed the order.
7. WITHDRAWAL OF THE CONTRACT. RETURNS.
7.1. The CUSTOMER has the right to cancel the contract within 14 days of receipt of the goods, and for this purpose, he can use the Standard Form for exercising the right of cancellation of the contract, which the CUSTOMER has received together with the received goods.
7.2. In case of cancellation of the contract, the CUSTOMER is obliged to return the purchased goods in undisturbed commercial form, preserved packaging and preserved label, the cost of returning the goods is at the expense of the CUSTOMER.
7.3. Upon cancellation of the contract, if the CUSTOMER has paid for the goods, he shall be reimbursed the amount paid for the returned goods to the bank account specified by him within 14 / fourteen / days after the return of the goods. Amounts shall not be refunded until the Seller receives the goods returned by the CUSTOMER or until the CUSTOMER provides the Seller with proof that he has sent the goods back.
7.4 The CUSTOMER agrees that the reimbursement shall be made by bank transfer to his bank account specified by him, and this reimbursement will not be related to the expenses for the CUSTOMER except for any expenses according to item 6.5 above. The costs related to the transfer of the amount to the bank account specified by the CUSTOMER shall be borne by the Seller. The cost of the Courier related to the return of the goods is at the expense of the CUSTOMER.
7.5. The right to withdraw from the contract in cases where the goods are received by the CUSTOMER cannot be exercised for sealed goods which are printed after delivery and cannot be returned for reasons of hygiene or health protection.
7.6. In case of non-conformity of the received goods with the ordered goods, the CUSTOMER has the right to file a claim by requesting the Seller to bring the goods in compliance with the order. When filing a claim, the CUSTOMER must also enclose the documents on which the claim is based (cash receipt, etc.). Disagreement in the agreement between the parties may be expressed in:
manufacturing defects in the goods;
missing parts of the goods found;
wrong goods shipped other than ordered;
non-compliance with the announced size and / or color - the goods sent in different sizes and/or colors from the orders;
7.7. The complaint under item 7.6 shall be filed within two years of delivery of the goods, but no later than two months after the establishment of non-compliance with the contract. The claim under item 7.6 may be filed with GOTAWER EOOD at the specified email address firstname.lastname@example.org, at the same time the CUSTOMER must send the goods for replacement within one week.
7.8. In the event of a claim, the CUSTOMER may choose to replace the particular item for the same without defects or in another size or different color or return the goods for a refund. The Seller may suggest that the replacement of the item be with a completely different item when price is equal - or the CUSTOMER pays if the other item is more expensive, or several items are offered for the same price, or the CUSTOMER is refunded the difference between the replaced and the new item if the price of the new item is lower than the price paid by the CUSTOMER. The CUSTOMER cannot claim the termination of the contract if the non-compliance of the CUSTOMER goods with the contract is negligible.
7.9. The return of the goods at the claim, in cases outside the factory defect, is carried out under the following conditions:
Good commercial appearance (goods are not torn, scratched, worn, washed, ironed).
No damage caused by improper use.
Original packaging and label retained.
7.10. The return of the goods, either in case of cancellation of the contract or in the case of a claim, may be made in the manner and at the address indicated in the Return Form with which the Customer has received the order.
7.11. In the case of an exchange of goods, the transport costs shall be borne by the CUSTOMER in both directions, unless the replacement was due to the fault of the Seller.
8.1. All information published on the site www.pironetic.com is the property of GOTAWEAR EOOD, incl. all images, presentations and item descriptions.
8.2. It is prohibited to copy texts from www.pironetic.com and to place them on other websites and online stores without the written consent of GOTAWEAR EOOD. or without citing the source and without placing a link to www.pironetic.com.
9.1. The seller of the goods is responsible for the defects of the goods, for the execution of the distance sale contract, as well as for the repayment of the sums paid.
9.2. The Seller assumes no responsibility in the event that the shipped goods are not delivered, delayed and / or damaged during their delivery by the Courier.
9.3. The Seller assumes no liability whatsoever in the event that the CUSTOMER is misled by third parties who represent themselves as representing the interests of GOTAWEAR EOOD.
9.4 The Seller shall not be liable for any damages suffered by the CUSTOMER or by third parties as a result of force majeure or those which are beyond the control of the Seller.
9.5. In all other cases, the Seller's liability is limited to the value of the ordered and paid goods.
9.6. The CUSTOMER is obliged to inform GOTAWEAR EOOD in the presence of attempts according to item 9.3, using the available contact forms
10. CONFIDENTIALITY AND PERSONAL DATA.
10.1. By entering into a Sales Agreement, the Seller shall be entitled to process the personal data provided by the CUSTOMER in the performance of the order in order to execute the concluded Sales Agreement, insofar as the Seller's website does not contain any other explicit request for consent from the CUSTOMER in connection by processing his personal data.
10.2. Seller's activity is in accordance with the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and on the cancellation of Directive 95/46 / EC (General Data Protection Regulation), where relevant personal data protection information is available on the Seller's website at www.pironetic.com.
